Nassau County Supreme Court grants Firm’s motion to dismiss claim for coverage under title insurance policy

In an action involving, among other things, a claim for declaratory judgment declaring that the Firm’s client, a title insurance company, is obligated to provide coverage under a title insurance policy, the Court granted the Firm’s motion to dismiss based on the plain language of the policy at issue and the fact that the loss claimed to have been suffered by the Plaintiff was caused by its own agent, triggering an exception to coverage under the title policy.  Eric J.
