New York Supreme Court grants summary judgment to Firm’s client declaring recorded Zoning Declaration and Development Agreement and Licenses to be null and void and cancelled of record

In an action involving a dispute over title and zoning rights with respect to two adjacent commercial real estate properties in Manhattan, the Firm successfully moved on behalf of its client, the owner of one of the commercial properties, for summary judgment declaring a zoning declaration and zoning development agreement recorded against the properties to be null and void.  In granting summary judgment to the Firm’s client, the New York County Supreme Court agreed that the recorded documents failed to comply with the Zoning Resolution of the City of New York and were therefore not valid.  The Court rejected the Defendant’s arguments that the Plaintiff was estopped from challenging the validity of the recorded zoning documents.  Eric J.
